Flourwise Application Terms of Service

1.1 Definitions
The following terms used in these Terms have the following meanings:
- Application – Flourwise mobile application available in Google Play Store, designed for managing baking recipes, ingredient calculations and baking schedule planning.
- Service Provider / Administrator – Mariusz Lasak, ul. Zakopiańska 19, 34-323 Ślemień, Poland, Tax ID: 6443468840, email: support@flourwise.com, owner and administrator of the Application.
- User – natural person, legal entity or organizational unit without legal personality using the Application.
- Terms – this document defining the rules for using the Application.
- Account – collection of User's local data stored on mobile device (recipes, settings, baking journal).
- Premium Service / PRO Version – paid subscription offering access to extended Application features.
- User Content – data entered by User into the Application (recipes, photos, notes, schedules).
- Device – mobile device with Android system on which the Application is installed.
1.2 Scope of Terms
1. These Terms define the rules for using the Flourwise Application. 2. Using the Application is equivalent to accepting these Terms. 3. The Terms are available free of charge in the Application (Settings → Terms of Service) and at [https://flourwise.com/terms]. 4. The User is obliged to comply with the provisions of these Terms.
1.3 Conditions for Using the Application
1. The Application is intended for persons aged 18 and over. 2. Persons under 18 years of age may not use the Application. 3. Using the Application requires: - Device with Android system version 7.0 (API 24) or higher - Acceptance of Terms of Service and Privacy Policy
2. Application Functionality
2.1 Basic Features (Free Version)
The free version of the Application offers:
- ✅ Baker's calculator (hydration, preferments, ingredient proportions)
- ✅ Baking recipe management (add, edit, delete - recipe limit)
- ✅ Baking journal with notes and photos
- ✅ Step-by-step baking mode with timers
- ✅ Baking task schedule
- ✅ Rye and wheat sourdough starter management
- ✅ Recipe export to PDF
- Recipe limit: 10 active recipes
- Baking session limit: 5 active sessions per month
2.2 Premium Features (PRO Version)
Premium subscription includes:
- ✅ Unlimited recipes – no limit on stored recipes
- ✅ Unlimited baking sessions – no monthly restrictions
- ✅ Advanced calculator features – additional calculation modes
- ✅ Priority support – faster response to inquiries
- ✅ Advanced export – export to CSV, JSON formats
2.3 Data Storage
1. Local data: All User Content is stored locally on the Device. 2. No cloud: The Application does NOT synchronize data with external servers. All data remains on your device. 3. Backup: User can independently create backups and restore data.
3. Rules for Using the Application
3.1 User Obligations
The User agrees to:
1. Use the Application in accordance with its intended purpose. 2. Not undertake actions violating law, good customs or rights of third parties. 3. Not use the Application in a way that hinders use by other users. 4. Not copy, modify or decompile the Application source code. 5. Not introduce content inconsistent with law (including pornographic content, inciting violence, violating copyrights).
3.2 Prohibitions
It is forbidden to:
1. Use the Application in a manner violating applicable law. 2. Introduce viruses, malware or other harmful code. 3. Impersonate other persons or entities. 4. Violate copyrights and intellectual property rights. 5. Bypass Application security or technical limitations. 6. Exploit Application errors for gain. 7. Sell, rent or share the Application with third parties without Service Provider's consent.
3.3 Consequences of Terms Violation
In case of Terms violation, the Service Provider has the right to:
1. Block access to Premium features without refund. 2. Report the matter to appropriate authorities (in case of law violation).
4. Subscriptions and Payments
4.1 Premium Subscription Rules
1. Subscription types: - Monthly (renewed every 30 days) - Annual (renewed every 365 days) - One-time lifetime purchase (access without time limit)
2. Prices: Current subscription prices are available in Google Play Store and may vary by region.
3. Payments: Payments are handled by Google Play Store in accordance with Google's policies.
4.2 Automatic Subscription Renewal
1. Monthly and annual subscriptions are automatically renewed. 2. Payment is automatically charged 24 hours before the subscription period ends. 3. User can cancel subscription at any time in Google Play Store settings. 4. Canceling subscription prevents automatic renewal but does NOT result in refund for unused period.
4.3 Subscription Management
1. Subscription cancellation: - Android: Open Google Play Store → Menu → Subscriptions → Flourwise → Cancel subscription
2. Refunds: - In accordance with Consumer Rights Act and Google Play Refund Policy.
4.4 Price Changes
1. Service Provider reserves the right to change subscription prices. 2. Price changes apply to new subscriptions and renewals after the change date. 3. Users will be notified of price changes with 30 days' notice.
5. Right of Withdrawal
5.1 Consumer Rights (Art. 27 Consumer Rights Act)
In accordance with Polish consumer law:
1. Term: Consumer has the right to withdraw from the contract within 14 days without giving reason. 2. Beginning of term: Term runs from the day of contract conclusion (subscription purchase). 3. Form: Withdrawal statement can be sent to email: support@flourwise.com.
5.2 Loss of Right of Withdrawal
In accordance with Art. 38 point 13 of the Consumer Rights Act, right of withdrawal does NOT apply in case of:
- Digital content delivered in non-durable manner (e.g., digital subscription), if Consumer expressly consented to start of service performance before 14 days expire and was informed about loss of right of withdrawal.
5.3 Google Play Refunds
Google Play Store offers refund policy:
1. Refund within 48 hours: Possible through Google Play Support form (for first purchase of given product). 2. Refund after 48 hours: Only upon request to Service Provider (email: support@flourwise.com).
6. Liability
6.1 Service Provider Liability
1. Limitation of liability: - Application is provided "as is". - Service Provider is not liable for: - Improper operation of Application resulting from causes on User's side (e.g., incompatible device, lack of system updates). - Data loss resulting from Application deletion, device reset or lack of backup. - Damages resulting from using the Application (e.g., incorrect baking calculations).
2. Warranties: - Service Provider will make efforts to ensure Application works correctly and is free from errors. - Service Provider does not guarantee 100% error-free Application.
3. Disclaimer: - Service Provider is not responsible for actions of third parties (e.g., Google LLC regarding payments). - Service Provider is not responsible for inability to use Application resulting from independent causes (e.g., Google Play Store failure).
6.2 User Liability
User bears full responsibility for:
1. Content entered into the Application (recipes, photos, notes). 2. Violation of third party rights (e.g., publishing someone else's recipes without consent). 3. Damages caused by Terms violation.
6.3 Data Backup
1. User obligation: User is obliged to regularly create backups of their data. 2. Tools: Application offers backup export function (Settings → Data and privacy → Backup). 3. No liability: Service Provider is not liable for data loss resulting from lack of backup.
7. Personal Data
1. Processing of Users' personal data is carried out in accordance with Privacy Policy available in the Application and at [https://flourwise.com/privacy-policy]. 2. Using the Application requires acceptance of the Privacy Policy. 3. Detailed information about data processing, GDPR consents and User rights can be found in the Privacy Policy.
8. Copyright and Intellectual Property
8.1 Application Rights
1. All rights to the Application (source code, graphics, user interface, trademarks) belong to the Service Provider. 2. The Application is protected by copyright law (Copyright and Related Rights Act). 3. User receives non-exclusive, non-transferable license to use the Application solely for personal use.
8.2 User Content Rights
1. Ownership: All User Content (recipes, photos, notes) remains User's property. 2. No Service Provider rights: Service Provider does NOT acquire any rights to User Content. 3. Usage license: User grants Service Provider limited license to process Content solely for providing Application services (e.g., display, save, export).
8.3 Prohibition of Copying and Modification
It is forbidden to:
1. Copy, distribute or disseminate the Application without Service Provider's consent. 2. Decompile, reverse engineer the source code. 3. Modify, translate or create derivative works without Service Provider's consent.
9. Complaints and Technical Support
9.1 Filing Complaints
1. Form: Complaints can be submitted to email: support@flourwise.com. 2. Submission content: Complaint should contain: - User's first and last name / name - Contact email address - Problem description / complaint basis - User's expectations
3. Response time: Service Provider will process complaint within 14 days from receipt date.
9.2 Technical Support
1. Contact: Questions and technical problems can be reported to email: support@flourwise.com. 2. Response time: - FREE users: up to 7 business days - Premium users: up to 48 hours (priority support)
10. Terms Changes
10.1 Right to Changes
1. Service Provider reserves the right to change Terms at any time. 2. Changes may result from: - Changes in applicable law - Introduction of new Application features - Security or usability improvements
10.2 Notification of Changes
1. Users will be informed about significant Terms changes through: - Notification in the Application - Email (if User provided address) - Update of "last updated" date in this document
2. Effective date: Changes take effect after 7 days from publication.
10.3 Non-acceptance of Changes
1. If User does not accept Terms changes, they have the right to stop using the Application. 2. Continued use of the Application after changes take effect means acceptance of new Terms.
11. Final Provisions
11.1 Applicable Law
1. These Terms are governed by Polish law. 2. In matters not regulated by these Terms, the following apply: - Civil Code - Electronic Services Act - Consumer Rights Act - GDPR Regulation (EU 2016/679)
11.2 Dispute Resolution
1. Amicable resolution: Parties commit to amicable dispute resolution. 2. Competent court: In case of no agreement, disputes will be resolved by common court competent for Service Provider's seat. 3. Alternative methods: Consumer can use: - Mediation - Consumer arbitration court at Trade Inspection - ODR Platform (Online Dispute Resolution): [https://ec.europa.eu/consumers/odr]
11.3 Severability Clause
If any provision of these Terms proves invalid or ineffective, remaining provisions remain in force.

12. Terms Acceptance
1. Using the Application is equivalent to accepting these Terms. 2. Upon first launch of the Application, User will be asked to accept the Terms and Privacy Policy. 3. Acceptance is voluntary but necessary to use the Application.
13. Compliance with Regulations
These Terms comply with:

14. Frequently Asked Questions (FAQ)
Q: Can I cancel my subscription at any time?A: Yes! You can cancel your subscription in Google Play Store at any time. You will retain Premium access until the end of the paid period.
Q: Will I get a refund if I cancel my subscription?A: No. Canceling subscription prevents next charge but does not refund current period.
Q: What happens to my data after uninstalling the app?A: All local data (recipes, settings) will be deleted. We recommend creating a backup before uninstalling.
Q: Can I use the app offline?A: Yes! All features work offline. Internet is only needed for synchronization with Google Play (subscriptions).
Q: Can I transfer my subscription to another device?A: Yes! Subscription is linked to your Google account. After logging in with the same account on another device, subscription will be restored.
Q: How do I report a bug or suggest a new feature?A: Write to us at support@flourwise.com or use "Report bug or idea" feature in Application Settings.
